ELIGIBILITY: This giveaway is open to legal residents of the United States and the District of Columbia who were 21 years of age or older as of 7/20/2020. Employees of Sponsor, Idaho Potato Commissioners, and agencies, agents and employees of the State of Idaho and all other service agencies involved with design, execution or fulfillment of this Sweepstakes, and members of the immediate families (defined for these purposes as parents, children, siblings, and spouse) or households (whether related or not) of any of the above are NOT eligible to enter or participate in any manner.
SWEEPSTAKES PERIOD: The Promotion begins at 9:00 a.m. Eastern Time ("ET") on October 29, 2020 and ends at 11:59 p.m. ET on November 25, 2020 (the "Sweepstakes Period"). All entries must be received before the Sweepstakes Period’s end time/date to be valid.
TO ENTER: During the Sweepstakes Period, subscribe to the Idaho Potato Commission Foodservice newsletter “The Latest Dish” to receive one (1) entry into the Sweepstakes.
Individuals who do not abide by these Official Rules or other instructions of Sponsor may be disqualified. Entries must comply with the entry requirements set forth herein to be valid. As used herein, “Entry” (and/or “Entries”) refers to all content you submit in connection with the Sweepstakes (including, but not limited to, photos, answers, descriptions, explanations, hashtags, tags, tag names, etc.), if any. By submitting an Entry into the Sweepstakes, you hereby warrant and represent that your Entry conforms to all Entry Requirements set forth herein.
The Idaho Potato Commissions’s computer is the official time keeping device for this Sweepstakes.
DRAWING: On or around November 25, 2020, Sponsor will randomly select one winner from among all eligible entries received. Odds of winning a prize depend on the number of eligible entries received during the Sweepstakes Period. Sponsor’s decisions are final and binding in all aspects.
WINNER NOTIFICATION: On or around November 25, 2020, Sponsor will notify the potential winner by sending an email to the address provided in subscription sign up. Potential winner will be required to respond to such notification within five (5) days by email in order for Sponsor to capture the winner’s name and address.
Potential winner is subject to verification. If a potential winner is found not to be eligible or not in compliance with these Official Rules, if attempted notification or any prize is returned as undeliverable, if any required documents are not returned within the required number of days, if a winner cannot be verified, or if a winner is otherwise unable or unwilling to accept and claim the prize as stated, then winner may be disqualified and the applicable prize may be forfeited in Sponsor’s sole discretion. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate entrant who will also be selected randomly. Winners may be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release, within ten (10) business days of attempted notification or prize may be forfeited. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.
PRIZE: One (1) verified winner shall each receive one (1) $500 Visa Gift Card. Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used. Please allow 2-3 weeks for fulfillment of prize after confirmation.
RELEASE: As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor and its officers, directors, employees and agents, and Sponsor’s affiliates, subsidiaries, retailers, and agents, and each of their officers, directors, employees and agents (“Promotion Parties”), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize or any item redeemed therewith; (b) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby knowingly and expressly waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and/or any rights to have damages multiplied or otherwise increased; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs.
PUBLICITY: Except where prohibited by law, winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her name, city of residence, photograph, and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation.
GENERAL TERMS & CONDITIONS: The potential Winner will be notified by email and must respond with seven (7) days of receipt of notification or prize will be forfeited. No alternate winners will be selected. The following documents will be forwarded to the potential Winner via email: An affidavit of eligibility, liability release and publicity release.
The return of any prize/prize notification as undeliverable or failure to return any documents in a timely manner may result in disqualification and an alternate winner may be chosen. By participating, participants agree to release, discharge and hold harmless Sponsor from and against any and all liability or damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Sponsor is not responsible for any typographical or other error in the printing of the offer or administration of the Promotion.
Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner’s name and likeness for purposes of advertising and publicity without further compensation, unless prohibited by law. By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the person's name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or acts in a disruptive manner. This Promotion is offered only in the United States and is governed by the laws of the State of Idaho. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Idaho located in the county of Ada for any action, suit or proceeding arising out of or relating to this Promotion.
LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, the corresponding entry will be deemed to be made by the authorized account holder of the email account from which the entry was submitted. Neither Sponsor nor its agencies are responsible for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.
Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of this Sweepstakes or Website, or may be acting in violation of the terms of the Website, or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse, or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of this Sweepstakes may be unlawful and subject to legal action by Sponsor or its agents.
